Terms of Service

These Terms govern access to and use of Automenax, including the website, dashboard, APIs, automations, mockup tools, listing tools, and fulfillment workflows. By creating an account, connecting an Etsy shop, or using the service, you agree to these Terms.

Automenax is an independent SaaS tool for Etsy sellers. It helps sellers create product-specific mockups, draft listings, manage listing fields and variations, read order context for fulfillment, and send shipment tracking updates through the Etsy Open API.

Automenax is not Etsy and does not act as Etsy support, a marketplace, a payment processor for Etsy sales, a legal advisor, a tax advisor, or a guaranteed source of Etsy search ranking.

You must comply with Etsy's Terms of Use, Seller Policy, API Terms, Intellectual Property Policy, Prohibited Items Policy, Creativity Standards, production partner rules, and any other Etsy rules that apply to your shop.

Etsy API availability, rate limits, endpoints, policies, and scopes may change. Automenax may change, suspend, or remove features when required by Etsy policy, law, security, or API behavior.

The term "Etsy" is a trademark of Etsy, Inc. This application uses Etsy's API but is not affiliated with, endorsed by, sponsored by, or certified by Etsy. Etsy is not responsible for this application, the Application Developer, or any content, service, listing, result, or claim made through Automenax.

You must be at least 18 years old and able to enter a binding agreement. You are responsible for your account credentials, users, connected shops, automations, billing, listing content, and any action taken from your workspace.

When you connect an Etsy shop, you authorize Automenax to call the Etsy Open API on your behalf within the scopes you grant. You can disconnect from Automenax or revoke access from Etsy at any time.

Automenax uses OAuth 2.0 Authorization Code flow with PKCE and CSRF state protection. Tokens are stored encrypted and used only to operate the connected-shop features you use.

Automenax creates and updates draft listing content for seller review. You are responsible for reviewing titles, tags, descriptions, images, variations, inventory, pricing, production partner disclosures, delivery profiles, and compliance before publishing on Etsy.

Automenax does not guarantee that a draft will be accepted by Etsy, comply with every marketplace rule, avoid infringement, rank in search, convert to sales, or remain active after publication.

You retain ownership of artwork, source files, listing text, and other content you provide. You grant Automenax a limited, non-exclusive, revocable license to host, process, transform, transmit, and display that content only to provide the service.

You confirm that you will not use Automenax to upload, generate, sell, or publish:

• Copyright-infringing artwork, stolen designs, copied bundles, or scraped content.
• Trademark-infringing brand names, logos, phrases, or confusingly similar designs.
• Misleading, counterfeit, prohibited, unsafe, hateful, adult-restricted, or illegal products.
• Designs that violate privacy, publicity, personality, or image rights.
• False claims about handmade status, origin, materials, delivery times, or personalization.

Buyer names, delivery addresses, order details, personalization notes, and tracking data may be used only for the specific Etsy order, fulfillment, support, security, and legal compliance. You may not use that data for unsolicited marketing, retargeting, enrichment, unrelated outreach, or resale.

• No illegal activity, fraud, spam, phishing, scraping, or abuse.
• No attempts to bypass Etsy policies, Etsy checkout, or Etsy API limits.
• No security testing without written permission.
• No uploading malware, secrets, payment card data, or unnecessary sensitive data.
• No reverse engineering except where law clearly permits it.
• No use that harms Etsy buyers, sellers, Automenax, Etsy, or third parties.

AI-assisted outputs can contain mistakes, similarity risk, policy issues, or inaccurate claims. You must review and approve generated mockups, listing copy, tags, product details, and fulfillment data before relying on them.

• Paid plans are billed through Stripe.
• Subscriptions renew unless canceled before the renewal date.
• Usage credits and plan limits are displayed in the product when applicable.
• Fees are non-refundable except where required by law or expressly stated.
• Taxes may be charged based on billing location and legal requirements.

We may suspend or terminate access for non-payment, security risk, abuse, IP infringement, marketplace policy violations, legal risk, or material breach of these Terms. You may close your account at any time. Data deletion is handled under the Privacy Policy and Data Deletion page.

The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted operation, error-free automations, Etsy API availability, search ranking, sales, legal compliance of seller content, or marketplace acceptance.

To the maximum extent permitted by law, Automenax is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, Etsy ranking, or business opportunity. Our total liability is limited to the fees paid to Automenax in the 12 months before the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless Automenax from claims, losses, damages, liabilities, and expenses arising from your content, listings, products, shop operations, production partner choices, buyer communications, breach of these Terms, violation of law, or violation of third-party rights.

These Terms are governed by the laws stated in your signed order form or subscription agreement. If no separate agreement exists, disputes will be handled by the competent courts for the legal residence or principal place of business of Automenax, unless mandatory consumer or data-protection law provides otherwise.

We may update these Terms when the service, law, or Etsy platform rules change. Material changes will be communicated by email or in-app notice when required.
